I read with interest the article on this web site from Surrey County Council regarding the successful conviction of Zenith Staybrite Ltd who admitted ten offences under Consumer Protection from Unfair Trading Regulations following an investigation by Buckinghamshire and Surrey Trading Standards. The conviction saw the firm being ordered to pay £330k.

My attention was drawn to this particular story not because I have been ripped off by this firm like the people in the originating article but because I receive persistent nuisance calls from the firm since 2005. Despite complaining bitterly to the firm on several occasions the calls still persist, the latest being on fathers day last Sunday (18th June 2017).

In May 2016 I wrote to Zenith Customer services department to complain about the calls and they wrote back to confirm that my details had been removed from their database with 14 days. Yet the calls still persist even though I have followed up to complain again on several occasions since.

Whenever, the firm calls they ask for a Mr Sadat. My family have lived in this property since it was built so no one else has ever lived here so Mr Sadat has never lived here. Therefore, I assume they have purchased data from an unscrupulous source.

My phone number is ex-directory and has been registered with the TPS since 2004. Therefore, the calls I receive from Zenith Staybright Ltd are in direct contravention of the Privacy and Electronic regulations 2003.

Due to the ineffectiveness of the TPS, and the irritation that Zenith Staybright Ltd brings to my family, I have invested in BT Call Guardian phones for our home.

Based on the recent conviction and my personal experiences I am of the opinion that there are fundamental issues with the trading practises of Zenith Staybright Ltd, therefore I call on the ICO to investigate Zenith for flouting the Privacy and Electronic regulations 2003. Their blatant disregard for the regulations seriously calls into question the effectiveness of the Telephone Preference Service.
